It seems interesting that the Supreme Court turned down in the last few years all circuit cases related to Williamson County. This case came directly from the Florida Supreme Court. So I'm speculating that whatever the Supreme Court they have to say they want to say it directly to the State courts.

Don’t know how this could put Williamson County to its overdue demise , but it would be nice!

This will also be the first time a land use case ( in recent history) is decided without O’Connor. Many people believe the Kennedy was the pivotal person, maybe he was/is but O’Connor was the powerhouse (See Lingle v. Chevron) that kept the boys on track. I don’t think Sotomayor will be able to fill that power void given her relative inexperience with Property cases (see Didden v. Village of Port Chester) and the newness of her position.
Ok Ok, Sotomayor is not a fait accompli, but it appears that way. This may cause the pendulum to swing back toward Scalia.

Anyhow I now have you on my short list of prophets to listen to.
Now all I need is a small carpet

Regards,

ClaudeMaine Land Use Bloghttps://www.blogger.com/profile/14735536830258340471noreply@blogger.com
